Penal proceedings and convictions
In the most serious cases, penal proceedings for illegal practice of the profession of lawyer may be instituted by the Bar of Montreal or the Barreau du Québec before the Court of Québec (Criminal and Penal Division).
In accordance with Section 188 of the Professional Code, the mandatory minimum fine for a first offence is:
- In the case of a natural (physical) person, not less than $2,500 $ nor more than $62,500
- In other cases (businesses, etc.) not less than $5,000 nor more than $125,000
In the case of a subsequent offence, the minimum and maximum fines are doubled.
